On September 04, 2020 Governor Newsom signed Assembly Bill 2257
which contains CMHI’s Amendment which exempts licensed mobilehomes
sales persons (MSP) from the ABC Test established in Assembly 5 for
determining Independent Contractor status.
Independent Contractor status for MSP’s will be determined by the S.G. Borello multi-factor test which was in use prior to the AB5 three point test.
AB 2257 is an urgency statute which became effective upon the Governor’s signature on September 04, 2020
