Senate Bill 9 ADU Split Lot Law Modified

Senate Bill 9, passed in 2021, permitted up to four homes on split lots in single family zoned neighborhoods which sparked the market for Accessory Dwelling Units.

In an April 24, 2024 ruling a Los Angeles County judge ruled that Senate Bill 9, specifically Government Code Section 65852.21 does not apply to charter cities.

While all California cities and counties operate under ‘California General Law” charter cities operate under their own constitutions that can override state law on zoning provided they are not in conflict with matters of the state concern.

The Attorney General’s office is reviewing the judge’s ruling and “will consider all options in defense of Senate Bill.”
